Husband has all income & owes federal taxes. Can I file Injured spouse to get back child tax & EIC credits?

If all the income was his, then filing injured spouse won't get you anything, since when they allocate it, none would be allocated to you.





If you live in a community property state, rules are different, but you still wouldn't get back the whole child tax and EIC credits, just part of them. If you live in a community property state you can file. You would get 1/2 of the child tax credits and only if the tax return actually shows a refund from these. No. It isn't your withholding or credits and EIC generated by yoru income. You are not injured. Annoyed, yes, injured no. In a community property state you would split the income on separate returns along with withholding and child tax credit. Neither of you would get earned income credit on a separate return.
