If all the income was his, then filing injured spouse won't get you anything, since when they allocate it, none would be allocated to you.
If you live in a community property state, rules are different, but you still wouldn't get back the whole child tax and EIC credits, just part of them. If you aren't in a community property state, you'd get nothing.Husband has all income %26amp; owes federal taxes. Can I file Injured spouse to get back child tax %26amp; EIC credits?
If you live in a community property state you can file. You would get 1/2 of the child tax credits and only if the tax return actually shows a refund from these. The EIC goes to him because he earned it.Husband has all income %26amp; owes federal taxes. Can I file Injured spouse to get back child tax %26amp; EIC credits?
No. It isn't your withholding or credits and EIC generated by yoru income. You are not injured. Annoyed, yes, injured no. In a community property state you would split the income on separate returns along with withholding and child tax credit. Neither of you would get earned income credit on a separate return.
